Rental terms and conditions
The terms that apply when you book a stay at Caribbean Luxury Apartments.
These terms apply to every booking of the holiday apartment offered by Via Boncompagni Holding S.à r.l. Please read them before you book. The information about the accommodation, the price and the booking confirmation form part of the agreement together with these terms.
1. Who we are and what these terms mean
The landlord is Via Boncompagni Holding S.à r.l., with its registered office at Rue de Luxembourg 295, 8077 Bertrange, Luxembourg, registered in the Luxembourg trade and companies register under number RCS Luxembourg B249086. You can contact us at info@caribbeanluxuryapartments.com or +31 6 26003457.
In these terms, "we" or "landlord" means Via Boncompagni Holding S.à r.l.; "you" or "guest" means the person making the booking; "fellow travellers" means the other people staying in the apartment with you; and "apartment" means the holiday apartment in Curaçao named in the booking confirmation. Recreatie Online B.V. provides the website and booking platform, but is not the landlord and is not a party to the rental agreement or the payment.
You must be at least 18 years old to book. If you book for others, you make sure they know and comply with these terms. You remain responsible to us for the obligations of your fellow travellers and visitors.
2. Booking and agreement
A request is not yet a booking. After you submit your preferred dates and details, we review the request and may hold the dates for you temporarily. We aim to respond within 48 hours. If we approve the request, you will receive a confirmation by email, followed by an invoice (see article 4).
An approved request is not yet final. The rental agreement is concluded and the booking becomes final as soon as we have received the full invoice amount. If you do not hear from us within 48 hours, there is no booking and you cannot derive any right to the apartment from the request.
Please check the confirmation and the invoice straight away for names, dates of stay, number of guests, price and any additional costs. Report an error as soon as possible and no later than 48 hours after receipt, so that we can check it and, where possible, correct it.
The booking applies to the stated period of stay and the number of overnight guests named in the confirmation. Only the named guests may stay overnight. Additional guests or visitors must be approved by us in writing in advance. Without permission we may refuse entry to unregistered persons. The maximum occupancy is 6 persons.
3. Price, minimum stay and additional costs
The agreed rental price is stated in the booking confirmation and applies to the accommodation, period of stay and occupancy stated there. The price per night depends on the period. The confirmation also states whether tourist tax, cleaning, linen, resort fees or other local costs are included or must be paid separately. Amounts collected on site are stated clearly in advance.
The minimum stay is 7 nights. During the Christmas periods (19 December 2026 to 2 January 2027 and 25 December 2027 to 9 January 2028) the minimum stay is 14 nights.
If the published price is incorrect because of an obvious error, we will inform you as soon as possible. You may then cancel the booking free of charge. We may only apply a corrected price if you expressly accept it.
Electricity and air conditioning: consumption is included in the rental price. We do not charge any additional energy fee.
4. Payment
You pay Via Boncompagni Holding S.à r.l. and not Recreatie Online B.V. You do not pay through the website: once we have approved your request, we send you an invoice for the full amount, with payment details and the final payment date. You pay the full amount in one payment; there is no deposit and no remaining balance.
The booking is only final once we have received the full amount. If you do not pay by the date stated on the invoice, we will send you a reminder with a reasonable final payment deadline. If payment is still not made, we may terminate the request in writing and the dates become available again to other guests. We do not charge costs that have not been communicated in advance or are not legally permitted.
5. Cancellation or changes by the guest
You can withdraw a request that we have not yet approved free of charge by sending a message to info@caribbeanluxuryapartments.com.
No cancellation policy applies to this apartment. Once the booking is final, you cannot cancel it free of charge and we will not refund the amount paid, unless we agree otherwise with you in writing or mandatory law provides otherwise. If you cancel or do not show up, the full amount remains payable. Article 6 (cancellation by us and force majeure) remains unaffected.
A change of dates or stay is only possible with our written consent. If we cannot accept the change, the original booking remains in force. Leaving early voluntarily does not give an automatic right to a refund for unused nights, subject to mandatory law or a written agreement to the contrary. We recommend that you take out suitable travel and cancellation insurance.
6. Cancellation or changes by the landlord and force majeure
If we cannot make the apartment available, we will inform you as soon as possible. If reasonably possible, we will offer a comparable alternative. If you do not accept that alternative or no suitable alternative is available, we will refund the amounts received for the stay not provided within 14 days, to the extent applicable law requires this. Any further rights you have are determined by applicable law.
An event beyond a party's reasonable control may make performance temporarily or permanently impossible. Examples are serious damage to the apartment or building, a natural disaster, extreme weather, government measures, an epidemic, closure of an airport or port, prolonged failure of essential utilities or a strike that prevents performance. The affected party informs the other party as soon as possible and takes reasonable steps to limit the consequences.
If the event means that the apartment cannot safely or reasonably be offered as habitable, the first paragraph of this article applies. If the apartment remains available but you cannot reach Curaçao because of circumstances on your side, such as cancelled flights or travel restrictions, article 5 applies in principle, subject to mandatory law. The consequences are always assessed on the basis of the nature and seriousness of the event and the applicable law.
7. Deposit, damage and extra cleaning
We do not ask for a deposit. You are, however, liable for damage caused by you, your fellow travellers or your visitors, except for normal wear and tear and to the extent the damage cannot be attributed to you.
We may charge you after your departure for reasonable and demonstrable costs of damage, missing inventory or exceptional extra cleaning. We will provide you with a breakdown and, where reasonably available, proof of the costs. Extra cleaning can only be charged where demonstrably necessary, for example because of indoor smoking, excessive soiling or another breach of the house rules.
8. Arrival, stay and departure
Check-in is possible from 16:00 on the day of arrival. Check-out is no later than 11:00 on the day of departure. A different time is only possible with prior written consent. Well before arrival you will receive practical information about key handover or access code. Report any delay to +31 6 26003457.
If you do not arrive and have not told us, we will contact you using the contact details provided. If you do not respond within a reasonable time, we may treat this as a cancellation and re-let the apartment, applying article 5, to the extent legally permitted.
On departure, leave the apartment tidy: dishes washed, rubbish removed and furniture and inventory put back. Whether the final cleaning is included in the price is stated in your booking confirmation (article 3). These normal departure tasks do not replace the final cleaning.
9. House rules and facilities
You and your fellow travellers comply with these terms, the house rules in the apartment and the applicable rules of the resort, the owners' association and the apartment complex. These include rules on noise, swimming pool, parking, waste, security and shared facilities. We provide the relevant rules before or on arrival.
- Be considerate of neighbours between 22:00 and 07:00.
- Smoking is not permitted indoors.
- Pets are not permitted unless we give written permission in advance.
- Parties, events, commercial activities and disruptive gatherings are not permitted without our prior written permission.
- Only registered guests may stay overnight. Visitors are only permitted with prior written permission.
- Subletting, transferring the booking or giving keys/access codes to unauthorised persons is not permitted.
- Use the swimming pool, balcony and other facilities with care and follow all safety rules displayed on site. Children must be supervised by a responsible adult at the pool and other risky facilities.
- Report faults, damage or unsafe situations immediately to us or the local manager.
In the event of a serious or repeated breach, we may ask you to stop the breach immediately. If the breach continues or causes a serious safety risk or serious nuisance, we may terminate the booking and ask you to leave the apartment. Any refund, costs and liability are assessed under applicable law and the circumstances of the case.
10. Maintenance, complaints and repair
We ensure that the apartment is offered in reasonable condition as described. Report a defect or complaint during your stay as soon as possible via +31 6 26003457 or info@caribbeanluxuryapartments.com, so that we have the opportunity to investigate and, where possible, remedy it. We try to respond within a reasonable time. In an emergency or in case of a safety risk, call the telephone number provided immediately.
If a facility temporarily does not work, we take reasonable measures to arrange repair. A problem does not automatically entitle you to a discount or compensation; the assessment depends, among other things, on its nature, seriousness, duration, cause and consequences and on mandatory law. A complaint that could not be resolved during the stay can be submitted in writing via info@caribbeanluxuryapartments.com. We confirm receipt and in principle respond within 14 days. This does not affect statutory complaint and limitation periods.
11. Liability and insurance
You use the apartment, the inventory and the facilities with care and follow reasonable safety instructions. You are responsible for damage attributable to you, your fellow travellers or visitors. We advise you to have suitable travel, health and liability insurance.
We are liable for damage to the extent it results from a failure for which we are responsible under applicable law. To the extent legally permitted, we are not liable for indirect damage or loss of personal belongings that cannot be attributed to us. Nothing in these terms excludes liability for intent, wilful recklessness, injury or death caused by our attributable failure, or any other liability that cannot validly be excluded or limited. Any liability cap applies only to the extent legally permitted and is not applied where prohibited.
12. Applicable law and disputes
The booking and these terms are governed by the law that applies under the relevant conflict-of-law rules. To the extent a choice of law is valid, we choose Luxembourg law. This choice does not deprive you of the protection of provisions that cannot be derogated from by agreement. Mandatory rules relating to the location of the apartment in Curaçao may also apply.
A dispute will be submitted to the court that has jurisdiction under applicable mandatory law. A choice of forum for Luxembourg applies only to the extent it is valid and respects consumer rights and other mandatory jurisdiction rules.
These terms were last updated on 9 October 2026.
